Thousands of PT Freeport workers in Papua, Indonesia have held a strike since May 1, 2017. In the five years of this strike, more than a hundred people have died due to depression because their fate is still in limbo. The government is considered to have failed to take steps to resolve it. On Friday (6/5), one of the workers at PT Freeport who led the strike, Aser Koyamee Gobay, again noted that one of his colleagues had died. “It has died 111 people. This morning I heard that someone had died in the house, rotting. He’s a strike employee. He was not sick, but depressed. How come. Five years people do not accept obligations from the company. The government also cannot solve this problem. In this case, the central government,” Aser told VOA, Friday (6/5) night. According to the records of the Papua Legal Aid Institute (LBH), at least 8,300 PT Freeport workers decided to join the strike. This institution, together with Lokataru, became a companion for the thousands of workers to fight for their rights. The strike that started on May 1, 2017 was triggered by PT Freeport’s steps to implement employment policies, such as furlough or employee housing. This step was taken because at that time, PT Freeport had doubts about the future of its operations and investment in Papua. The company’s move was responded to by thousands of workers by going on strike. Since then, the dispute between the workers and PT Freeport has not reached a common ground, and the thousands of workers have lost their income without any clarity on the salary or severance pay to which they are entitled.
The governor of Papua once sent a letter asking PT Freeport to immediately re-employ thousands of striking workers. However, the request was not responded to. In 2018, the government assumed control as the owner of a 51 percent stake. However, Aser added, there is still no follow-up from the center, either from the Ministry of Manpower or the Ministry of Energy and Mineral Resources. “In this case, the government, through the mining SOE holding MIND ID or Freeport-McMoRan as a company, is responsible for resolving strikes and fulfilling workers’ rights,” said Aser. During these five years, said Aser, workers can only wait for the central government’s steps to resolve the problem. “Strike members are waiting for law enforcement and justice in the regions. However, the government must resolve the strike issue, according to a rigid mechanism,” said Aser again. The lawyer for the 8,300 PT Freeport workers from LBH Papua, Emanuel Gobay, also claimed that the strike was an exercise of the workers’ rights. Law 13/2003 concerning Manpower, said Gobay, stipulates that one of the rights of workers is to strike. Therefore, he continued, the strike shows that the 8,300 people are still active as Freeport workers. “They are exercising their rights. This was also confirmed by the decision of the Supreme Court regarding the layoffs lawsuit filed by Freeport against five workers who were on strike. In the opinion of the Supreme Court judge, it was stated that the five people were exercising their rights. In this case, strike,” said Gobay. The Supreme Court’s decision was issued in 2021. By law, through its decision, the Supreme Court acknowledged that the strike did not change their status as active workers. Gobay also regrets that since the Indonesian government became the majority shareholder with 51 percent at the end of 2018, no changes have occurred. At the same time, the complaints of 8,300 Freeport workers to Komnas HAM in 2017 and 2018 have been responded to by issuing two recommendations from the institution.
Which is addressed to the President, to solve this problem. However, the President ignored that and focused only on the issue of the share struggle. And they have already obtained the shares, but the recommendation from Komnas HAM which hangs on to this day has not been followed up. That’s why we call them victims of the implementation of the Minerba policy,” added Gobay. In fact, as the majority shareholder, the responsibility for resolving these 8,300 striking workers, according to the Director of LBH Papua, rests with the government. Gobay also reminded, article 28, paragraph 4 of the 1945 Constitution contains respect, protection and fulfillment and enforcement of human rights. Therefore, it is the duty of the government to fully resolve this issue. The same pressure was given to the Papua Regional Government, because according to the initial agreement, they were the holders of 10 percent of Freeport’s shares. However, as a shareholder, the Governor of Papua only sent an urging letter to PT Freeport in 2018. The letter contained a statement that strikes are a legitimate right and that PT Freeport immediately reactivate the 8,300 and pay their wages. Gobay reminded that this strike is also a humanitarian problem. Along with the 8,300 workers, there are also their families who have lost their source of income. This includes losing their BPJS membership to pay for their health.
The attitude of the state which only sees this is like wanting these workers to die slowly. Moreover, today’s fact is that more than a hundred workers have died, who went on strike, because they were unable to pay for medical expenses due to their BPJS being revoked,” said Gobay. VOA has contacted PT Freeport Indonesia’s Manager External & Media Relations Corporate Communications, Kerry Yarangga. PT Freeport chose not to comment on this matter.
